When a prospective client has been cited for a first/second non-violent drug offense, they are required to attend Tribal Court. The Tribal Prosecutor reviews these cases, and if the offender is a candidate that would benefit from early alcohol/drug rehabilitation, the Tribal Prosecutor will discuss the Wellness Court Program with the prospective client and recommend a referral to the Wellness Court (Key Component (KC) 3). There are also times when a Tribal Judge may refer a prospective client to the Wellness Court. (KC 2) The prospective client will meet with the Team, which includes a Tribal Judge, Tribal Prosecutor, Defense Attorney, Alcohol and Other Drug Addiction (AODA) Treatment Supervisor/Intake Counselor, Probation Officer, Master Sergeant of MTPD, and the Wellness Court Coordinator. (KC 1) The Defense Attorney explains the nature and purpose of the Wellness Court Program, the rules, incentives and sanctions, and how participation in the Wellness Court Program can provide the opportunity to create positive life changes. (KC 2)
