The Diversion/DPA project gives low- to moderate-risk participants the opportunity to demonstrate changes in thinking and behaviors that have led to violations of law and subsequent prosecution for those violations, particularly those with substance abuse involvement. The option of a Diversion or Deferred Prosecution Agreement option is determined by the court and/or the District Attorney's Office when a misdemeanor or felony case is being prosecuted and alcohol and/or drug use was a significant factor. The program accepts pre- and post-charge participants, therefore either Diversions or DPA agreements are options for participants. Participation in the TAD program is voluntary, and eligible participants must have an identified substance use need and be willing to comply with program requirements. Eligible participants must be nonviolent offenders, not possessing any charges that pertain to use of force, weapons, battery, assault, burglary, sex offenses, and/or homicide. All participants are provided case management services, which typically includes urinalysis and saliva drug testing, attendance at office contacts, work toward desired goals per developed case plans, cognitive-behavioral assignments, and referrals to treatment and other services as appropriate. Upon completion of their agreement, Diversion participants see the benefit of having their charge(s) removed for their offense, and DPA participants experience their charge(s) either reduced or dismissed. The goals of the program are to ultimately reduce recidivism rates for nonviolent participants, to increase public safety, to reduce jail populations by diverting these nonviolent offenders into community-based interventions, and to ultimately reduce prosecution and incarceration costs in Ozaukee County.
