Post-charge Diversion and Deferred Prosecution Program

Description: 
The primary referrals are individuals who were referred for or arrested for a crime involving alcohol or drugs or the use of substances. These referrals are post-charge and include both deferred prosecution and deferred judgment of conviction agreements. The intent is to keep low risk offenses/individuals from convictions by allowing an opportunity to follow an agreement with the Court. Interventions range from Restorative Services, anger management and domestic violence classes to alcohol/drug treatment referrals. DIV participants are subject to drug/alcohol testing and ultimately sign a deferred prosecution agreement or deferred judgment of convictions that are approved by the Court. In exchange for completion of the program and terms of their agreement, the Court either dismisses the case/count or the charge is amended to a lesser charge; this is determined at the time the individual signs the agreement.
