The Dane County Drug Courts are multi-agency collaborations operated in two separate courts that provide prosecution and sentencing alternatives to the criminal justice system for persons with substance use problems. The courts serve Dane County residents who are referred on felony non-violent drug driven charges who are at high risk to re-offend. Graduates of these year-long programs can have charges reduced or dismissed and have periods of incarceration reduced or eliminated.

OWI Treatment Court

Description: 
The Dane County OWI Treatment Court aims to reduce the number of repeat intoxicated drivers, thereby increasing community safety. This court-supervised program for repeat intoxicated drivers will provide intensive case management and treatment to hold participants accountable while providing opportunities for making positive changes. Post-charge Diversion and Deferred Prosecution Program

Description: 
The Deferred Prosecution Program (DPP) is run by the Dane County District Attorney's Office. Eligible defendants can avoid a criminal conviction and sentencing by satisfying the requirements of a deferred prosecution agreement contract. The contract may require the defendant to participate in one or more of the following assessments or programs: alcohol and drug assessment and comply with any recommended treatment; abuser / generalized aggression treatment; attend issue specific, DPP, or parenting classes; pay restitution; complete community service work; and secure psychological / psychiatric, vocational and or any other counseling DPP deems necessary. Participants also agree to other appropriate measures to assure they do not repeat criminal behavior. Operating within DPP are the Deferred Prosecution - Opioid Diversion Program (DPP-O) and Deferred Prosecution - Child Abuse Initiative (DPCAI). These programs serve defendants with eligible charges and may require additional assessments, classes, treatments, etc. All participants must comply with any existing bail conditions at all times throughout the duration of their contract without exception.

Pre-arrest Diversion Program (Proxy)

Description: 
In 2017, the MPD first created the Madison Area Addiction Recovery Initiative (MAARI) which was at the time and continues to be a LE led pre-arrest diversion program for persons suspected of having Opioid or Substance Use Disorder (OUD). To be eligible individuals must be 18 and over and have been found by a LE officer to have committed a drug related crime but OUD or SUD is suspected to be the at root cause of the criminal behavior. All Madison police officers receive training to identify such situations and refer eligible participants to MAARI in lieu of arrest and criminal charges. When individuals are referred to the MAARI program, they undergo a comprehensive clinical assessment at the Dane County Treatment Readiness Center for OUD or SUD; agree to a six-month "MAARI Arrest Diversion" plan in lieu of facing criminal charges; and then connected with local treatment providers, other counseling services and peer support. When a participant completes their six-month MAARI Arrest Diversion plan, they receive a letter of congratulations from the Chief of Police acknowledging their MAARI program accomplishment and beginning of their recovery journey. The participant is also officially notified that as a result of their completion of MAARI, all MPD charges associated with the initial referral to MAARI have been "voided" by the department. Lastly, the MPD's non-profit partner (the Madison Community Policing Foundation) provides all MAARI program completers with a $100 VISA gift card.

Deflection Program

In March 2021, the MPD created an Addiction Resource Team (ART) to fulfill the Active Outreach and Naloxone Plus deflection pathways. The ART is comprised of officers specifically trained in addiction, and peer support recovery coaches. The ART is supported by an MPD Data Analyst who daily queries 911 call data to identify addresses where a suspected, non-fatal opioid related of overdose occurred. The Data Analyst then helps the ART create and prioritize their visit list for that day. Usually midafternoon on most weekdays, the ART uses an unmarked MPD mini-van and travels about the City of Madison looking to make contact with individuals who have recently overdosed. Once contact is made, individuals are introduced by MPD to Peer Support Recovery Coaches from Safe Communities Madison-Dane County. A conversation then occurs with the individual and information provided on available community treatment resources related to Substance Use Disorder. The ART also offers "harm reduction" to the individual or household by providing Narcan/Naloxone in the event of another overdose in the future.

In September 2023, MPD modified ART and rather than one dedicated officer, the MPD now uses an ART cadre of over 30 officers who have been trained in how to approach and engage with individuals who have recently survived a non-fatal overdose. ART Cadre officers paired with Peer Support Specialists from Safe Communities work four-hour overtime shifts, Tuesday through Thursday, between the hours of 2:00 p.m. and 8:00 p.m. The Data Analyst continues to create the outreach visit list that identifies specific individuals and addresses who are eligible for an ART visit as a result of a recent non-fatal (or fatal) drug related overdose.
